Applicant claimed $5,000 for lost baggage – Flair paid applicant $2,300, which it claimed was the maximum required under the Air Passenger Protection Regulation (“APPR”) – applicant claimed APPR maximum did not apply because he never checked in and instead left airport, so was not an air passenger – Tribunal found the APPR applied – bag was in Flair’s care because applicant was scheduled as an air passenger – Flair already paid the maximum required – claim dismissed
