IATA updates COVID-19 financial impacts, says relief measures needed

  • Denied boarding – Heimal v Air Canada – 2020 BCCRT 249
    Passenger denied boarding international flight – did not have Schengen visa – passenger stated she did not need visa; applicant held Belorussian passport and permanent Canadian residency – airline relied on IATA ‘Timatic’ system to verify travel document requirements – system flagged passenger because she was travelling through Schengen – airline assumed that connecting flight layover required visa – visa not required – airline’s tariff waived liability if airline denied boarding while acting in good faith – airline’s employees made mistake; no bad faith – claim denied
  • Implementation complaint – Air Canada v CUPE, Air Canada Component – 2020 CanLII 17275 (CA LA)
    Union originally complained that Air Canada mainline economy service did not meet collective agreement standard – arbitrator agreed and required Air Canada to amend service standard – Air Canada delayed amending – did begin issuing notes to staff – did not communicate its notes to union; asked union after implementation time-limit expired for extension – Air Canada allowed to delay: large change in operation needs flexibility and time to effect – monetary damages not appropriate

    WestJet applied to amendment certificate – exclusion of Operations Duty Managers – Canadian Air Line Dispatchers Association did not oppose – amendment granted – new certificate reads:

    all dispatchers employed by Westjet, an Alberta Partnership, excluding the Operations Duty Managers (e.g., Network Duty Managers and Operations Shift Managers), the Safety Investigators II, the Manager of Flight Dispatch, the Manager of Flight Operations Support and those above.
