(“WK”) for flight with China Eastern Airlines Corporation Limited (“CEA”) – CEA cancelled flight due to COVID – CEA cancelled applicants’ flight credit because not used within one year – one-year limit not a term of agreement between the parties – WK, as agent for CEA, not liable in addition to CEA – CEA ordered to pay $1,430.34 for tickets plus interest, fees, and expenses

Applicants claimed Air Canada did not allow them to board because it misinterpreted policy regarding timing of positive COVID test – Tribunal agreed with Air Canada that Air Passenger Protection Regulations regarding “denial of boarding” did not apply because that applied only to overbooking – However, Air Canada misinterpreted COVID-19 travel restriction policy and therefore breached contract with applicants – Tribunal ordered $595.93 in damages for food, hotel, transportation, and change fee, plus interest and fees
