DECISIONS

  • Compensation, denial of boarding – Younus v. Flair Airlines Ltd., 2023 BCCRT 419

Claim for compensation for denial of boarding – applicant sought compensation under the Air Passenger Protection Regulation (“APPR”) and reimbursement of related travel expenses – Flair claimed that applicant’s inability to board was due to a “technical glitch” – Flair claimed no compensation was owed under the APPR, which it said covers only overbooking – Tribunal found that whether there was a glitch or not, ultimately Flair did not seat the applicant on the plane because it was already full – applicant was denied boarding within the meaning of the APPR – compensation ordered in the amount of $2,602.12 – claim for reimbursement of accommodation and transportation costs dismissed

Claim for compensation for flight delay – applicants sought compensation under the APPR – Air Canada admitted that delay was a result of “crew constraints”, but also said they were safety constraints due to the COVID-19 pandemic that were outside of its control – Air Canada claims no compensation was owed under the APPR – Tribunal found that Air Canada failed to establish that the delay was outside of its control or due to safety constraints – applicants entitled to compensation under the APPR – compensation ordered in the amount of $1,561.78
