Claim for compensation for baggage delay – applicant’s baggage did not arrive in Orlando before he boarded a 9-day cruise – applicant claimed $5,000 for clothing and necessities purchased during his trip – Air Canada argued that it had already paid the applicant the maximum compensation allowable under the Montreal Convention, rendering the claim moot – Tribunal found Air Canada liable – evidence that applicant had not accepted Air Canada’s earlier e-transfer payment – compensation ordered in the amount of $2,327.04

Claim for compensation for baggage delay – applicants claimed $4,401.48 under the Air Passenger Protection Regulation (APPR) for a 7-day baggage delay and for their purchase of replacement items – WestJet argued that only 2 of the purchased items, totalling approximately $300.00, were essential and reasonable expenses under the APPR – Tribunal held that one of the applicants was entitled to some compensation, but found that the majority of the claimed expenses were unreasonable and excessive – compensation ordered in the amount of $310.18
