Canadian Transport Agency to Publish Red Tape Review Report

The Canadian Transportation Agency (CTA) has issued its Red Tape Review Progress Report 2025. The Report identifies three initiatives to ease the administrative burden for organizations within the transportation system and support the commitment by the Government to lower costs for Canadians and to build a stronger economy. This report illustrates the CTA’s commitment to help ensure that the national transportation system runs efficiently and smoothly in the interests of all Canadians.

Grievance, Union Chairperson hours of work – International Association of Machinists and Aerospace Workers for Transportation District Lodge 14, Local Lodge 1734 v Swissport Canada Inc.2025 CanLII 91540 (CA LA) Union claimed that Letter of Agreement (“LOA”) stating Union Chairperson was a “full-time position” entitled grievor to 40 hours per week – grieved reduction of hours below that threshold – arbitrator found wording to mean that Union Chairperson would be someone already employed on full-time basis – “Union Chairperson” a union position, not employer position – LOA did not guarantee weekly hours of work – grievance dismissed

Interest arbitration – Greater Toronto Airports Authority v Pearson Professional Firefighters’ Association2025 CanLII 90061 Three-year renewal collective agreement for group of approximately 90 firefighters – increases to wages, differentials, pension contributions, and benefits – introduction of overtime bank carry-over, active-member benefits for retirees to age 65, post-65 retiree Health Care Spending Account, Line of Duty Death benefit, and reimbursement of renewal and medical certificate costs for DZ driver’s licence – introduction of Firefighter 4th Class category at 70% of salary and reduction of recruit rate to 60% of salary

Appeal and cross-appeal from judgment – termination of aircraft purchase agreements following Bexair’s failure to make required payments – Bombardier entitled to retain deposits as liquidated damages on all agreements – global calculation of amounts owed deemed appropriate – unpaid invoices not claimed, so could not be awarded – expert accountant costs granted as legal fees, not damages – determination of damages for loss of value claim found to be abusive was remitted to Superior Court
