Constitutional challenge of the Secure Air Travel ActBrar v Canada (Public Safety and Emergency Preparedness), 2022 FC 1168

Challenge that sections 8 and 9(1)(a) of the Secure Air Travel Act (“SATA”) infringe on the Appellants’ mobility rights under section 6 of the Charter and whether sections 15 and 16 of SATA, which govern the appeals process, violate section 7 of the Charter – found sections 8 and 9(1)(a) alone do not infringe the Appellants’ mobility rights, but the SATA scheme itself does – infringement justified under section 1 of the Charter – found the Appellant’s section 7 Charter rights were engaged, but done so in accordance with the principles of fundamental justice – section 1 analysis not required.
