WestJet loses appeal of B.C. court decision on harassment lawsuit

    Plaintiff, a WestJet employee, requested certification of class action – alleged that “anti-harassment” promise existed in employment contract – WestJet replied that jurisdiction for harassment was the Canadian Human Rights Tribunal – the Canadian Human Rights Act requires employment contracts to have anti-harassment promises – appeal dismissed – law of contract creates cause of action independent of legislation – human rights promises may be enforced through contractual obligations – trial court best placed to evaluate facts
