Air Canada Flight Attendants Contracts: Here’s What You Need to Know

The union representing 10,400 Air Canada flight attendants and the company will soon sit down with a conciliator to try to work out a new contract. But if they fail, the airline could be hit with a strike in mid-August.

CUPE, which represents the flight attendants, filed for conciliation last week after contract talks broke down. The contract between Air Canada and CUPE members, which had been in effect for 10 years, expired in March.

Small claims, flight cancellation – Hennigar v. Sunwing Airlines Inc., 2025 NSSM 20 Claimant sued Sunwing Airlines (“SWA”) for two cancelled flights – SWA claimed that Sunwing Vacations (“SWV”) was correct entity, not SWA – court found that both were proper parties – SWA and SWV were closely related and SWV was agent for SWA – SWV added as defendant – claimant sought $2,652.76, representing difference between refunded flights and cost of more expensive replacement flight and meals during layover – claimant argued that Montreal Convention and Air Passenger Protection Regulations required carrier to offer alternative flight at no additional cost – court found that SWA and/or SWV’s business model was to sell enough tickets to fill plane and to cancel flight if not enough passengers secured – business plan is SWA and/or SWV’s control – no evidence that SWA and/or SWV took all measures reasonably required to avoid damage, or that it was impossible to take measures – SWA liable under Montreal Convention – SWV liable for breaching contractual obligation – SWA and SWV jointly and severally liable for damages – court awarded $2,652.76 plus costs of $200.00

Appeal, class action, airport fees – Air Canada c. P.A., 2025 QCCA 518 Appeal of amount of compensation that could be claimed by members of class action – after Air Canada’s practice to charge obese or disabled travellers for a second seat was found to be discriminatory, trial judge ordered that cost of second ticket be reimbursed to members – Air Canada claimed that it should not have to reimburse airport improvement and security fees associated with ticket – Court noted that compensation aims to make members whole – not reasonable to expect individuals to seek reimbursement of taxes and fees from relevant government agencies and airports – Court confirmed class action members are entitled to full cost of second ticket including applicable fees and taxes – appeal dismissed
