Claim for compensation for missing luggage – applicant seeking $1,961.81 as compensation for lost luggage – WestJet claimed luggage, which was returned to applicant 23 days later, was only delayed – WestJet argued applicant was accordingly entitled only to compensation for damages arising from delay, and not to value of luggage contents – WestJet had already paid $338.19 to applicant and argued it owed no further amounts – reimbursement of value of luggage contents in the circumstance would overcompensate applicant – however, applicant not yet fully compensated for incidental expenses – WestJet ordered to pay applicant $311.63 for other essential purchases reasonably made in context of applicant’s missing luggage

Application by WestJet, an Alberta Partnership (WestJet) seeking, amongst other things, a declaration that the sale of Sunwing Airlines Inc. (Sunwing) to WestJet constitutes a sale of business within the meaning of the Code – Board determined that a sale of business occurred – Board declined to review existing bargaining unit structure in relation to the sale of business declaration – WestJet declared the successor employer of Sunwing – International Association of Machinists and Aerospace Workers certified to be bargaining agent for unit comprising “all employees of WestJet, an Alberta Partnership at the Toronto-Lester B. Pearson International Airport carrying out aircraft maintenance and ground support functions, including aircraft maintenance engineer (AME) supervisors, interior technicians and ground support technicians, excluding administrative employees, clerical employees, those above the rank of supervisor, and those employees covered by Board order no. 11834-U”
