DECISIONS

Compensation, missing luggage – Audette v. WestJet Airlines Ltd., 2024 BCCRT 38
Claim for compensation for missing luggage – applicant seeking $1,961.81 as compensation for lost luggage – WestJet claimed luggage, which was returned to applicant 23 days later, was only delayed – WestJet argued applicant was accordingly entitled only to compensation for damages arising from delay, and not to value of luggage contents – WestJet had already paid $338.19 to applicant and argued it owed no further amounts – reimbursement of value of luggage contents in the circumstance would overcompensate applicant – however, applicant not yet fully compensated for incidental expenses – WestJet ordered to pay applicant $311.63 for other essential purchases reasonably made in context of applicant’s missing luggage

Compensation, flight delay – Cowden v. Air Canada, 2024 BCCRT 34
Claim for compensation for international flight delay – first leg of applicants’ return flight delayed, causing them to arrive at final destination more than 14 hours later than scheduled – applicants seeking $2,000.00 as compensation for delay – Air Canada claimed delay was outside of its control – Air Canada argued it only had to provide alternative travel arrangements to applicants under Air Passenger Protection Regulations (APPR) – Air Canada met obligations to applicants under APPR – applicants not entitled to compensation
