Judge rejects former Kelowna bride’s proposed class action lawsuit over flight delays

    Certification application – Plaintiff alleged, amongst other things, that defendants fraudulently misrepresented non-stop flights between Kelowna and Cancun – Plaintiff sought to represent class of people who bought direct flights from the defendants but experienced delays due to fuel stops – Plaintiff’s claims covered exclusively by the Montreal Convention – Plaintiff’s claims as plead bound to fail – Application dismissed with leave to amend granted
