Claim for compensation for accommodation and meal expenses following flight cancellation – BC Supreme Court’s Air Passenger Rights decision binding on Civil Resolution Tribunal (Tribunal) – decision specifically found Tribunal did not have jurisdiction over claims under Air Passenger Protection Regulations – Tribunal concluded that to consider claim under Montreal Convention would be inconsistent with Air Passenger Rights decision – Tribunal also noted ongoing claim related to same facts before Canadian Transportation Agency – Tribunal refused to resolve claim
