Air Canada suspends more than 800 unvaccinated workers under new federal rules

Judicial review, Human Rights – Zoghbi v. Air Canada, 2021 FC 1154
Applicant sought judicial review of dismissal of human rights complaint by the Canadian Human Rights Commission (“CHRC”) – CHRC held that complaint was frivolous, because even if Applicant’s complaint well-founded, any meaningful remedy would be foreclosed by the Carriage by Air Act (“CAA”)– Federal Court found CHRC had not considered alternate remedies to those foreclosed by the CAA – Federal Court concluded the CHRC’s decision to dismiss Applicant’s complaint as trivial was unreasonable – Federal Court allowed judicial review.
