The Union representing flight crew filed a grievance arguing that time spent renewing the ID card required to access airports’ restricted areas should be compensated as time worked. It also claimed that the training required by the Toronto Airport during the renewal process should be deemed to be training counting towards flight hours under the collective agreement. The arbitrator found, however, that the renewal process was managed by CATSA and that no clause in the collective agreement required the employer to assume responsibility for the process. In the absence of a clear definition of “training”, the arbitrator reviewed various relevant clauses and concluded that under the collective agreement, “training” referred to training offered or approved by the employer and related to flight crew qualification. She further concluded that the training in question was not approved or validated by the employer and therefore did not fall under the scope of training counting towards flight hours under the collective agreement. In the end, the Union’s grievance was dismissed.
