    Employee made Canada Labour Code complaint for unjust dismissal – airline transport pilot – pilot completed training on new type – pilot expressed interest in being promoted to captain – peer reviews determined pilot not ready for upgrade – airline supported future promotion – chief pilot for type determined pilot was not proficient; pilot met individual proficiency standards in training – pilot dismissed in the interest of aviation safety – Code protects non-management employees from dismissal without cause – employee entitled to damages – damages to be calculated

    Passenger claimed $5,000; denied boarding international flight: name on infant daughter’s ticket did not match identification – round-trip flight – passenger denied boarding on return leg – flights operated by Lufthansa – Air Canada argued that Lufthansa was liable for denied boarding – passenger did not have compelling evidence of typographic error – passenger’s financial claims were not supported by evidence – compensation denied

    Employee initiated judicial review – employee terminated by employer; alleged that union had not fairly represented him – Industrial Relations Board denied complaint – Federal Court of Appeal denied review – criteria for duty of fair representation complaint are: union acted in bad faith, arbitrarily, or in discriminatory fashion – none of these proven – employee could not prove breach of natural justice – application dismissed
