Four friends experienced delays on both outbound and return flights – claimed $1,000 per flight under APPR, for total of $2,000 per passenger – also claimed $150 for loss of night at hotel, and travel and food expenses – airline agreed to $1,000 compensation for return flight – Court noted that airline bears burden of proof once delay is established by passenger – Court concluded delay on outbound flight was due to fuel leak and required for safety – no entitlement to APPR compensation – Court reaffirmed Montreal Convention bars moral damages – however, Court also concluded airline did not provide evidence of steps taken to mitigate damages – additionally, Court found airline’s failure to provide timely compensation for return flight entitled passenger to interest starting upon expiry of 30-day APPR timeline for payment – passenger awarded total of $1,217.35 with interest and legal fees – remaining three passengers reached $1,650 settlement with airline prior to hearing
