Grievors were pilots who agreed to participate in simulator activity on day off – union argued they should have received premium pay even if activity was cancelled – issue of contractual interpretation – arbitrator found collective agreement was silent with respect to cancellation of simulator activity – arbitrator rejected union’s past practice argument, stating it would reintroduce entitlement that parties agreed to remove from collective agreement – arbitrator also rejected union’s position that premium pay is triggered by accepting to work on day off, regardless of whether work is performed – grievances dismissed

Grievance, schedule, standby – L3Harris MAS Inc. v Aircraft Mechanics Fraternal Association2026 CanLII 53058 (ON LA)

L3Harris contracted to maintain fleet for CAF squadron – Aircraft Maintenance Engineers (AMEs) and Aircraft Technicians (ATs) occasionally accompany squadron on tanker missions – AMEs and ATs placed on standby when company informed of impending tanker mission – union argued collective agreement required AMEs and ATs to be on standby when squadron is on standby for tanker missions, i.e. 24/7, 365 days a year – arbitrator found language was clear and unequivocal – arbitrator rejected company’s argument that union’s interpretation was incompatible with other provisions – arbitrator noted that union did not acquiesce to standby assignment practice – arbitrator also found past practice cannot contradict unambiguous language – grievance upheld – issue of compensatory relief remitted to parties

Workers’ compensation, workplace accident – Air Canada et Bastwrous2026 QCTAT 2224

Employer appealed Commission determination that injury sustained by baggage attendant resulted from workplace accident – Tribunal concluded that contradictions, inconsistencies and ambiguities in worker’s testimony did not support workplace accident – appeal granted – worker not entitled to benefits

Board found that Executive Aviation was successor employer of Mara Tech Aviation Services following sale of business – Board found it did not have authority to issue order directing Executive Aviation Fuels Ltd. to execute collective agreement or deeming collective agreement to be operative under Executive Aviation Fuels name – UFCW certified to be bargaining agent for unit comprising “all employees of Executive Aviation Fuels Ltd. at the Greater Sudbury Airport performing ground handler and ground handler lead duties, excluding office and clerical staff, persons above the rank of supervisor, customer service agents, customer service leads, customer service trainers, fuel agents, fuel leads, mechanics and baggage delivery drivers”
