Constitutional challenge of confidentiality clause in the Canadian Transportation Act which prevents Conflict Resolution Officer decisions and reasons from being made public – Charter Advocates Canada (“CAC”) sought to intervene in application as friends of the court – Court found CAC did not have real, substantial and identifiable interest in subject matter of application – Court further found CAC did not add unique perspective to case – motion dismissed without costs

Compensation, boarding denial – Combes c. Air Canada, 2025 QCCQ 8001

Refugee refused boarding on flight to Bahamas for failure to present passport – Bahamas embassy website showed that Canadian travel document and permanent resident card were sufficient – Air Canada relied on IATA’s Travel Information Manual to determine required documentation for entry – Court stated Air Canada was not liable for conflicting information updated by third parties – tariff clearly indicated reliance on IATA’s Manual, which is publicly available – claim dismissed

Chauffeur was terminated 2 days after sustaining injury at work – worker filed claims for occupational injury and for unjust dismissal – in separate proceedings, Commission had recognized worker’s occupational injury and employer was appealing decision – employer raised preliminary objection to worker’s unjust dismissal claim on basis of timeliness – Commission found combination of circumstances constituted reasonable grounds for short delay in filing claim – Commission also found statutory presumption that termination was related to occupational injury applied – citing credibility issues, Commission held that employer did not successfully displace presumption – Commission ordered worker’s reinstatement subject to resolution of occupational injury claim

Flight attendant injured feet following fall during recertification exercise – worker was subsequently diagnosed with Morton’s neuroma in left foot – Commission rejected claim for pre-existing condition – worker appealed – Tribunal found asymptomatic condition became symptomatic because of fall – Tribunal held that worsening of pre-existing condition due to a workplace accident constitutes an occupational injury (thin skull rule) – worker was therefore entitled to benefits – appeal allowed

Aircraft maintenance technician injured back following fall at work – Commission determined injury was consolidated with 2% functional limitations – Commission further determined worker was entitled to compensation for bodily injury in relation to remaining limitations – employer appealed – Tribunal confirmed consolidation date but denied any remaining functional limitations – Tribunal determined worker was able to work in pre-injury position as of consolidation date – worker was therefore no longer entitled to income replacement benefits – appeal partially allowed

Flight director fractured arm during a fall while on layover in Portugal – Commission rejected claim, concluding injury did not occur because of or in the course of employment – worker appealed – Tribunal found injury occurred during activity related to meeting an essential need (i.e., eating) while in commissioned service – Tribunal determined injury therefore constituted an occupational injury – appeal allowed

Workers’ compensation, timeliness – Gonzalez-Ulribe et Bombardier inc. Centre de finition Montréal, 2025 QCTAT 5297 

Commission rejected aircraft mechanic’s claim for occupational injury to fingers as being untimely – worker appealed – Tribunal found worker was only made aware of possible link between injury and employment in meeting with union representative in May 2024 – until then, worker believed he had personal condition related to his age and surgical history – claim was made within 6 months and was therefore timely – appeal allowed

Station attendant filed claim for occupational illness related to long-term harassment – Commission rejected claim as being untimely – worker appealed – Tribunal found delay to file claim began on day worker’s diagnosis was first made, not date of first incident of harassment – Tribunal determined claim was therefore timely – appeal allowed – parties’ request for anonymization of worker’s identity denied
