DECISIONS

Compensation, flight delay – Monteith v. Air Canada, 2023 BCCRT 1134
Claim for compensation for flight delay – applicant claimed compensation for flight delay under the Air Passenger Protection Regulations (APPR) – Air Canada argued that delay was caused by unexpected aircraft malfunction and that applicant was not entitled to compensation under the APPR or the parties’ contract – decision made without the participation of the applicant due to non-compliance with CRT’s mandatory directions – claim dismissed

Compensation, flight delay – Juniper v. Air Canada, 2023 BCCRT 1115
Claim for compensation for flight delay – applicant bought an international air travel ticket from Air Canada – applicant’s flight was cancelled on the day of its departure – applicant was rebooked on a flight one day later – applicant claimed compensation for flight delay, as well as reimbursement for ground transportation and meals – Air Canada argued that cancellation was due to weather conditions outside of its control – under Air Passenger Protection Regulations, Air Canada only had to provide alternative travel arrangements, not compensation – claim dismissed
