Canadian Transportation Agency orders Air Canada to pay passengers compensation for cancelled flight

Application for compensation for inconvenience under Air Passenger Protection Regulations – flight cancelled, leading to itinerary change and overall delayed arrival of over 15 hours – Air Canada denied claim on basis that cancellation was due to safety – at hearing, Air Canada argued that cancellation was out of their control, due to first officer being unable to complete refresher training required by Canadian Aviation Regulations – Air Canada ought to have known before day of flight that first officer had not completed required training – arguments and evidence did not address steps taken to replace first officer before that date, why cancellation did not occur earlier, alternatives to cancellation, or whether contingency plan was in place – in absence of evidence, Agency found cancellation within Air Canada’s control – each applicant entitled to $1,000
